Definitions

For the purposes of the Terms of Service, Acceptable Use Policy, Disclaimer and Confidentiality Contract, the following definitions apply:

“FDO”: the website www.fast-degrees-online.com, management, authorized officers, parent company and subsidiary companies and corporations, henceforth “FDO”.

“Client”: Any person who visits the website of FDO, contacts FDO, by any means and or uses the services of FDO, henceforth, “client”.

“Institution”: Any legally formed and operating institution contracting FDO to act as an authorized agent or intermediary for the purposes of processing confidential applications for the award of degrees or other certificates, henceforth “institution”.

“Award”: A degree or other certificate issued by a legally formed and operating institution, henceforth “award”.

“Services”: Confidential services performed by FDO on behalf of the Client in processing an award to be bestowed upon the Client, henceforth “services”.

“Making a Purchase”: The act of the Client contracting FDO to process a confidential application for an award of a degree or other certificate from the Institution/s, “henceforth “making a purchase”.

“Person named on the Degree”: The person named on the award issued by the Institution/s, henceforth: the “person named on the degree”. The person named on the degree is also considered an associated person.

“Cardholder”: The person, whether living or corporate, named on the credit card used to pay for the services, henceforth, “the cardholder”. The cardholder is also considered an associated person.

“Associated Person”: Any person, whether living or corporate, including the person named on the degree and the cardholder, who is involved in the procurement of the services of FDO either directly or indirectly. Any person, whether living or corporate, who aids, abets, assists, facilitates in any way or provides the means either directly or indirectly to publish, release or disseminate information in any way that breaches the Confidentiality Contract or which can be construed as breaching the Confidentiality Contract. An associated person includes but is not bound to the owner, operator, editor, publisher, host, Internet Service Provider, webmaster, administrator, moderator, website administrative contact, website technical contact, website billing contact of any means used to breach the Confidentiality Contract, henceforth “associated person”.

“Confidentiality Contract”: The legally binding contract, realized between the Client and FDO on the action of making a purchase which prevents the Client from disclosing any information to any third party in any way which may directly or indirectly permit a connection to be drawn between FDO and the Institution, henceforth “confidentiality contract”.

“Publish”: To make available to public access in a legible, audible or visual form information by any means, specifically including but not bound to, printed matter, books, magazines, journals, newspapers, television, radio, multimedia, Internet, websites, chat rooms, newsgroups, forums, usenet, telephone, mobile telephone, fax or emails, henceforth, “publish”.

“Publication”: The act of publishing or the means of publishing, henceforth, “publication”.

“Retro-Active Graduation”: The dating of an award in the past no earlier than the first day of January 1983, at the Client’s request, and subject to the Client’s legal declaration, henceforth, “retro-active graduation”.

“Legal Declaration”: The declaration made by the Client automatically on making a purchase that he or she has read, understands and agrees to be bound by the Terms of Service, Acceptable Use Policy, Disclaimer and Confidentiality Contract, henceforth “legal declaration”.

“Act of Bad Faith”: Any deliberate act by the Client to mislead FDO at any time during the making of a purchase. Any deliberate act by the Client that does not comply with the terms of the Terms of Service, Acceptable Use Policy, Disclaimer and Confidentiality Contract, henceforth “act of bad faith”.

“Surety Bond”: A risk transfer mechanism that guarantees the fulfilment of a legal obligation by parties involved in a contract, henceforth, “surety bond”.

“Surety Company”: A company that underwrites a contract through the issue of a Surety Bond, henceforth, “surety company”.

“$”: United States Dollars.

Terms of Service, Acceptable Use Policy and Disclaimer

In no event shall FDO be liable for any direct, indirect, incidental, consequential, special and exemplary damages, or any damages whatsoever, arising from the use, misuse, (or inability to use) or performance of this website or services provided or offered by any means, even if FDO has been advised of the possibility of such damages.

Although FDO goes to extraordinary lengths and takes all reasonable steps to safeguard the confidentiality of its services, the Client agrees to indemnify and hold FDO harmless from any claim or demand, including reasonable attorneys’ fees, made by the Client or any third party due to or arising out any breach of the Confidentiality Contract by the Client, by any associated person or by any third party.

The services provided to the Client by FDO may contain errors. While FDO does its best to maintain all services and will correct typographical errors due to its own negligence or that of represented Institutions, it cannot be held responsible for any errors, defects, lost profits, or other consequential damages arising from the use, misuse, (or inability to use) any documents or products provided or performance of any services offered or provided. The Client certifies any information submitted by the Client to be free from typographical errors and misspellings.

The Client agrees to indemnify and hold FDO harmless from any claim or demand, including reasonable attorneys’ fees, made by the Client or any third party due to or arising out of the Client’s use of, misuse of, (or inability to use) this website, awards, documents, products, or services through FDO, and any violation of these terms and conditions by the Client or any associated person working in conjunction with the Client.

FDO reserves the right to terminate any services, nullify or void any documents provided to the Client, or transactions with the Client at any time or for any reason, with or without notice should the Client violate this accepted use policy. Once terminated, the Client agrees not to use or display any documents, information, or products in any fashion and to destroy the award and all ancillary documentation.

The Client certifies and warrants on pain of perjury that all the following are true: The Client is aged 18 or more, the person named on the degree is a real, living person aged 18 or more and, in the case of Retro-Active Graduation requests, was aged 18 or more on date of the Retro-Active Graduation and had the relevant life experience, work experience or formal study to qualify for the award at that time. In cases where the Client is making a purchase for another party, the Client confirms that he or she has the written consent to do so of the person named on the degree. The Client has a full command of the English language. The person named on the degree has a full command of the English language. The Client declares that the person named on the degree has relevant life experience, work experience or formal study in the subject chosen. For an Associate degree the Client declares that the person named on the degree has at least two years relevant life experience, work experience or formal study. For a Bachelor degree the Client declares that the person named on the degree has at least four years relevant life experience, work experience or formal study. For a Master degree the Client declares that the person named on the degree has at least six years relevant life experience, work experience or formal study. For a Doctorate degree or Professorship the Client declares that the person named on the degree has at least eight years relevant life experience, work experience or formal study. The submission of a false declaration of relevant life experience, work experience or formal study will be deemed an act of bad faith.

The Client has read and understands the Terms of Service, Acceptable Use Policy, Disclaimer and Confidentiality Contract sections of this website. The Client has read, understands and agrees to be legally bound by all the clauses of the Confidentiality Contract. The Client understands that any degree obtained through FDO will most probably come from an Institution outside the Client’s own Jurisdiction. In the event that the Client makes a purchase, that purchase is made in good faith with the intention of obeying and respecting the Terms of Service, Acceptable Use Policy, Disclaimer and Confidentiality Contract, as outlined in this website. Any act by the Client not compliant with the Terms of Service, Acceptable Use Policy, Disclaimer and Confidentiality Contract will be deemed an act of bad faith.

The Client and any associated person reject absolutely the use of “public interest” or any similar concept as a defence for any Breach of Contract or act of bad faith. The Client and any associated person will appear promptly, in person, in a court or tribunal designated by FDO to answer charges related to breaches of the Confidentiality Contract or acts of bad faith. The Client and any associated person will not attempt to evade appearance in court or tribunal to answer charges related to breaches of the Confidentiality Contract or acts of bad faith and specifically refute any protection against extradition from any Jurisdiction named in this agreement.

The Client understands that it is illegal to request a degree dated in the future. The Client has checked diligently with local legislation in the Jurisdiction of residence and the intended Jurisdiction of use of the award that the possession and use of a foreign, unaccredited or privately accredited degree conforms with local legislation. The Client undertakes to check diligently the local legislation of any future Jurisdiction in which it is intended to use the award. Neither the Client nor any associated person is impersonating another person. Neither the Client nor any associated person is going to use any information, documents, products or services obtained through FDO to commit a crime or deceive authorities.

Neither the Client nor any associated person is going to copy or duplicate any documents obtained through FDO in any way. Neither the Client nor any associated person is a journalist or media professional acting in that capacity. Neither the Client nor any associated person is going to obtain an award or awards through FDO to publish a news story or article of any sort in any media whatsoever, specifically including but not bound to printed matter, books, magazines, journals, newspapers, television, radio, multimedia, Internet, websites, chat rooms, newsgroups, forums, usenet, telephone, mobile telephone, fax or emails. Neither the Client nor any associated person is a law enforcement officer or investigator acting in that capacity, nor acting on behalf of a law enforcement agency. Neither the Client nor any associated person is obtaining documents or products to use as evidence in any type of civil or criminal investigation. All documents obtained through FDO are for the Client’s personal use. The Client, the person named on the award and all associated persons agree to be bound by the terms of the Terms of Service, Acceptable Use Policy, Disclaimer and Confidentiality Contract. The Client, the person named on the award and all associated persons agree not to name any person associated with FDO (regardless of the form of that association), nor publish the name, address, telephone number, mobile telephone number, fax or email address of any person, corporate body or Institution associated with FDO (regardless of the form of that association).

Refunds and Cancellations

The purchase of services from FDO is subject to the following terms and conditions. Consumers are advised to review carefully before making any purchase.

Since your purchase is a custom and personalized product, it is deemed “used” upon receipt of payment, and as such, all purchases made are non-refundable or exchangeable. There is a strict no refund policy.

If services have been completely rendered and are awaiting shipment, the ONLY refund that can then be offered will be the shipping cost less a $70 handling and processing fee.

Confidentiality Contract

By making a purchase, the Client and any associated person agree to be irrevocably bound by this Confidentiality Contract. The Client and any associated person agree in perpetuity never to reveal by act or omission of action, directly or indirectly, information that could draw or could be construed as drawing a connection between FDO and the Institution by any means. This includes, but is not bound to publication in printed matter, books, magazines, journals, newspapers, television, radio, multimedia, Internet, websites, chat rooms, newsgroups, forums, usenet, telephone, mobile telephone, fax or emails. In the event that the Client or any associated person reveals by act or omission of action, directly or indirectly, information that could draw or could be construed as drawing a connection between FDO and the Institution by any means, including but is bound to information published in printed matter, books, magazines, journals, newspapers, television, radio, multimedia, Internet, websites, chat rooms, newsgroups, forums, usenet, telephone, mobile telephone, fax or emails, then they shall be guilty of Breach of Contract according to the terms of this Confidentiality Contract.

Penalties

In the event that the Client or any associated person breaches or causes to be breached the Confidentiality Contract, they shall be liable and agree jointly and severally to pay restitution to FDO, on demand, the sum of $100,000 for Breach of Contract. Any act of bad faith by the Client in not obeying and respecting the Terms of Service, Acceptable Use Policy, Disclaimer and Confidentiality Contract, as outlined in this website will be deemed to be an act of bad faith. Any Client deemed guilty of an act of bad faith, agrees to pay restitution to FDO, on demand, the sum of $100,000 for an act of bad faith.

Surety Bond

It shall be the responsibility of FDO to maintain a valid Surety Bond of a minimum value of $100,000 that shall be payable, in equal shares to FDO in the case that the Confidentiality Contract is breached in any way. In the event of a breach of the Confidentiality Contract, FDO shall make any and all information in its files about the associated persons responsible for the breach available to the Surety Company.

Privacy

FDO agrees to maintain confidential all information pertaining to the Client and the person named on the degree and not to sell, rent or otherwise disclose any such information. In the event of a Breach of Contact, the Client, person named on the degree and any associated person forfeits all rights to privacy and specifically authorises FDO to disclose any confidential information in its files to the Surety Company and any third party deemed appropriate by the management of FDO.

This Confidentiality Contract is deemed to be interpreted and enforceable in the first instance according to the Laws and Statutes of the United States, in the second instance according to the Laws and Statutes of the Jurisdiction of the billing address of the credit card used to make the purchase and in the third instance according to the Laws and Statutes of the Jurisdiction of residence of the Client and of any associated person and in the fourth instance according to the Laws and Statutes of any Jurisdiction to which the Client or any associated person should subsequently flee.

Specifically, the Jurisdictions covered by this Confidentiality Contract include, but are not bound to, the following Jurisdictions, which for the purposes of this Confidentiality Contract shall be deemed to include any and all colonies, protectorates, dependent territories, autonomous regions, semi-autonomous regions, commonwealths, states, provinces, administrative regions, administrative sub-divisions or holdings normally considered as belonging to that Jurisdiction as well as any military or civil aircraft in international airspace or military or civilian vessel in international waters registered in and flying the flag of that Jurisdiction.

Right To Change

FDO reserves the right to change or modify this Confidentiality Contract at any time, without reference to the Client, and the Client agrees to be bound by those changes or modifications provided the changes or modifications are made with the intent of strengthening or clarifying the Confidentiality Contract.
